Appreciate the report and commentary, however, I do not think merely posting a sign prohibiting some activity that is not harmful to others or public health, trumps federal or state law. I have been embroiled in many of these tifs between patients, caregivers and staff and the staff always loses. Best course of action is, for ED staff to always assume they are being recorded and remain professional and respectful in full knowledge that there is a subset of the population which endeavors to pursue a "got-'cha" mentality. Imagine a sign in an ED registration area (I have seen this) "...[we do not prescribe opioid pain medication]..." a middle finger, as it were, to people suffering coming for help. When that dives a patient to LWOT or not even to register, is tantamount to an EMTALA violation.
Point well taken - In California, it is not permissible to video someone without 2 party consent. That said, there is little one can do if they take a video and post it on facebook. Best practice is to exhibit a high degree of professionalism at all times - But, I still think that it bears making the policy point via signage that there are areas of the universe where privacy is still important , and hospitals are clearly one of those-
